Terms & Conditions

This Photography Client Contract (the "Contract") is entered into by and between Everline Imagery (the "Photographer") and the Client. By ticking the box below, the Client acknowledges and agrees to the terms and conditions outlined herein:

Services Provided

The Photographer agrees to provide professional photography services, including but not limited to:

Type of session: Commercial Photoshoot for advertising, marketing, or promotional purposes, as specified by Everline Imagery.

Date and time of session as communicated by Everline Imagery.

Location as communicated by Everline Imagery.

Fees and Payment

Total Fee: Amount communicated and agreed upon at booking.

Deposit: A non-refundable 50% deposit for custom quotes or a deposit of the half day (3 hours) or full day (6 hours) fee is required to secure the booking. The deposit represents a commitment to the session, covering time, preparation, and resources invested by Everline Imagery. If no images are selected following the session, the deposit will be retained in full as a service fee.

Image Purchase: After the session, the Client will select and purchase images individually at the pricing agreed upon at booking. Full payment for selected images is required before any images are delivered.

Payment Methods: Credit card, bank transfer, or other methods as specified by Everline Imagery.

Rescheduling and Cancellation

Rescheduling must be requested at least 2 days in advance and is subject to availability.

Cancellations result in forfeiture of the deposit.

If the Photographer cancels due to unforeseen circumstances, the session fee payment made by the Client will be refunded or an alternative date will be offered.

Everline Imagery reserves the right to cancel and terminate this agreement immediately if the Client is abusive, disrespectful, or engages in inappropriate behaviour towards the Photographer or any staff members. In such cases, all payments made will be forfeited.

Session Policies

Clients are expected to arrive on time. Late arrivals may result in reduced session time, which could affect the quality of the outcome and reduce the number of photo deliverables.

Deliverables

Edited Images: Number and specifics as outlined by Everline Imagery.

Delivery Format: High-resolution digital files via an online gallery.

Delivery Timeline: Standard delivery is estimated within 3–5 weeks from the date of order confirmation and full payment, including any additional images. Expedited delivery requests will incur an additional fee of $33 per image.

Additional Edits: Available for purchase as per Everline Imagery’s pricing guide.

Editing Style: Photos will be delivered in the editing style advertised throughout Everline Imagery’s website and social media platforms. Alternate editing styles will not be carried out.

Editing Standards

Editing includes cropping, straightening, floor and background cleanup, prop cleanup, skin and beauty retouching, colour correction, exposure adjustment, lens correction, and removal of marks from shoes, costumes, and outfits.

Advanced editing requests, including but not limited to the swapping of body parts or merging multiple photos into one, will incur an additional fee of $22 per image.

Copyright and Usage

The Photographer retains full copyright ownership of all images.

The Client is granted a non-exclusive commercial license to use the images for marketing, advertising, and promotional purposes, as agreed upon at booking.

The Client may not resell, sublicense, or transfer the images to third parties without explicit permission from the Photographer.

Unless requested otherwise in writing, the Photographer may use images for promotional purposes.

Liability

The Photographer is not liable for injuries, damages, or losses incurred during the session.

In the event of equipment failure or unforeseen circumstances, liability is limited to a refund of payments made.

Model Release

The Client is responsible for obtaining model releases from all individuals appearing in the photographs if required for their intended use.

Everline Imagery is not responsible for any legal implications resulting from the Client’s failure to obtain necessary permissions.

Governing Law

This Contract is governed by the laws of the State of New South Wales, Australia.

Entire Agreement

This Contract constitutes the entire agreement between the Photographer and the Client, superseding all prior agreements or understandings.

Acknowledgment

By making the deposit payment, I (the Client) understand and agree to the terms and conditions outlined above.
