Photoshoots with a ‘personal use’ license.

Photography Client Contract

This Photography Client Contract (the "Contract") is entered into by and between Everline Imagery (JC Mitchell Services Pty Ltd) (the "Photographer") and the Client.
By ticking the box, transferring the deposit/full payment, and participating in the photoshoot, the Client acknowledges and agrees to the following terms and conditions:

1. Services Provided

The Photographer agrees to provide professional photography services as described at the time of booking, including but not limited to:

  • Type of session: Dance Audition Photoshoot, Creative Dance Photoshoot, or other as specified by Everline Imagery.

  • Date and time: As communicated and confirmed by Everline Imagery.

  • Location: As communicated and confirmed by Everline Imagery.

2. Fees and Payment

  • Total Fee: As communicated and agreed upon at the time of booking.

  • Deposit: A non-refundable 50 % deposit is required to secure the booking. The deposit represents a commitment to the session and covers time, preparation, and resources allocated by Everline Imagery.

    • If no images are selected following the session, the deposit will be retained in full as a service fee.

  • Remaining Balance: The remaining balance is due 7 days prior to the scheduled session.

    • If the balance is not paid by the due date stated on the invoice, Everline Imagery reserves the right to debit the remaining amount from the Client’s nominated payment method before the photoshoot proceeds.

  • Payment Methods: Credit card, bank transfer, or other approved payment methods as specified by Everline Imagery.

3. Rescheduling and Cancellation

  • Rescheduling requests must be made at least 2 days in advance and are subject to availability.

  • Cancellations within 48 hours of the scheduled session will result in forfeiture of the deposit.

  • Cancellations made prior to the 48-hour window will incur a 10 % processing fee based on the total photoshoot fee, which covers administrative, scheduling, and payment-processing costs.

  • If the Photographer cancels due to unforeseen circumstances, all payments made will be refunded in full or an alternative date will be offered.

  • Everline Imagery reserves the right to terminate this agreement immediately if the Client is abusive, disrespectful, or engages in inappropriate conduct toward the Photographer or team members. In such cases, all payments made will be forfeited.

4. Session Policies

Clients must arrive on time for their session. Late arrivals may result in reduced session duration and a corresponding reduction in the number or quality of final deliverables.

5. Deliverables

  • Edited Images: As outlined by Everline Imagery at the time of booking.

  • Delivery Format: High-resolution digital files via an online gallery.

  • Delivery Timeline: Standard delivery is approximately 3–5 weeks from the date of order confirmation and receipt of full payment (including any additional image orders).

  • Expedited Delivery: Rush requests will incur a $33 per image fee.

  • Additional edits or prints are available for purchase as per Everline Imagery’s current pricing guide.

  • Photos will be edited in the signature Everline Imagery style as displayed on the website and social-media channels. Alternate or customised editing styles will not be accommodated.

6. Editing Standards

Editing includes: cropping, straightening, floor and background cleanup, prop cleanup, skin and beauty retouching, colour and exposure correction, lens correction, and removal of minor marks on shoes, costumes, or outfits.

Advanced retouching (including body-part swapping, compositing, or merging multiple images) will incur an additional fee of $22 per image.

Body alterations will strictly not be made to any images intended for audition purposes.
This includes changes to body shape, proportions, or technical alignment to ensure authenticity and fairness in audition submissions.

7. Copyright and Usage

All images remain the sole property and copyright of the Photographer.

Clients are granted a personal use license only, allowing printing, sharing on personal social-media accounts (with credit where possible), and private use.

Unless the photoshoot has been booked and confirmed as a commercial shoot, and commercial usage terms agreed upon in writing, all photoshoots are considered personal use only.

Images may not be sold, distributed, altered, or provided to any third party for commercial purposes, advertising, or promotional use without the Photographer’s prior written consent.

Example:
The Client may not provide images to their dance school, dancewear brand, or any other organisation for advertising, marketing, or promotional materials (including social media, websites, or print campaigns) unless a commercial license has been arranged and paid for.

Unless requested otherwise in writing, Everline Imagery retains the right to use images for portfolio display, website content, social media, and promotional purposes.

8. Liability

The Photographer is not liable for any injury, damage, or loss incurred during the session.
In the event of equipment failure, file corruption, or other unforeseen technical issues, liability is limited to a refund of payments made.

9. Model Release

Unless expressly declined in writing prior to the session, the Client grants Everline Imagery permission to use images for marketing, portfolio, and promotional purposes, including but not limited to online, print, and social-media platforms.

10. Governing Law

This Contract shall be governed by and construed in accordance with the laws of the State of New South Wales, Australia, applicable to Newcastle and Lake Macquarie.

11. Entire Agreement

This Contract constitutes the entire agreement between the Photographer and the Client, superseding any prior discussions, understandings, or agreements, whether verbal or written.

Acknowledgment

By ticking the box, transferring the deposit or full payment, and participating in the photoshoot, the Client confirms that they have read, understood, and agreed to all terms and conditions outlined above, and acknowledges that these terms form a binding agreement with Everline Imagery (JC Mitchell Services Pty Ltd).
